These Terms govern your use of EverySaving.com. By accessing or using the website, you agree to these Terms. If you do not agree, please do not use the website.

Who operates EverySaving.com

EverySaving.com is operated by Oberst B.V., Sarphatistraat 370, 1018 GW Amsterdam, the Netherlands. Oberst B.V. is incorporated in the Netherlands with registered number 14126660. In these Terms, "we", "us" and "our" refer to Oberst B.V.

What the website provides

EverySaving.com is a public information service that helps visitors find coupons, promotional codes, discounts and other offers from independent merchants and other providers. We do not provide consumer accounts, sell merchants' goods or services, process payments, or enter into purchase contracts with you through the website.

Offers are provided for convenience and may be changed, withdrawn, expired, inaccurate, unavailable, restricted to particular customers or locations, or subject to additional merchant conditions. A code or discount may fail to apply at checkout. You should verify the price, eligibility, expiration date and other conditions on the destination website before making a purchase.

We may decide which offers and merchants appear on the website and may add, edit, rank, suspend or remove content or features at any time. Displaying an offer or link does not mean that we endorse the merchant or guarantee the offer.

Minors and legal capacity

EverySaving.com is a general-audience website and is not directed to children under 13. Children under 13 must not submit coupon information or feedback, or otherwise provide personal information to us. If you are under the age of legal majority where you live, you may use the website only with the permission and supervision of a parent or legal guardian.

Merchant and destination websites

Merchants, partner platforms and other destination websites are independent of us. When you follow an outbound link, you interact directly with the destination website. Any purchase or other transaction is between you and the applicable merchant or provider, under that party's prices, terms, eligibility rules, delivery terms, return and refund policies, privacy notice and customer-service arrangements.

We do not control destination websites and are not responsible for their availability, content, products, services, checkout, security, privacy practices or customer service. Please review the applicable destination terms before relying on an offer or completing a transaction.

Monetized links and attribution

Some outbound merchant links may be monetized or tracked for attribution. We may receive a commission or other compensation if you follow a link or complete a qualifying transaction. You do not pay us to use the website, and this compensation does not make us a party to your transaction with the merchant. Attribution occurs only when you interact with an eligible offer or outbound link. Our Privacy Policy explains the related data processing.

Coupon submissions and feedback

You may be able to submit coupon information, coupon feedback, merchant feedback or other suggestions. You are responsible for what you submit. Submissions must be accurate to the best of your knowledge, lawful, relevant to the website, and free from content that infringes another person's rights. Do not submit confidential information, account credentials, personal information about another person, or codes that you are not authorized to share.

You retain any rights you have in your submission. You grant us a non-exclusive, worldwide and royalty-free license to review, reproduce and edit the non-personal content of your submission and, where you submitted content for publication, to publish and otherwise use it as reasonably needed to operate, promote and improve the website. The license lasts for as long as reasonably needed for those purposes and allows contracted service providers to handle the content only on our behalf. It allows us to present a submitted offer in a consistent format; it does not transfer ownership of your personal information. Our Privacy Policy explains how we handle personal information.

We may review, moderate, edit, reject or remove any submission. We are not required to publish a submission, explain a moderation decision or keep published content available. We are not responsible for submissions provided by visitors.

Acceptable use

You may use the website only for lawful purposes and in accordance with these Terms. You must not:

• submit false, misleading, fraudulent, unlawful, abusive or infringing content;
• introduce malware or other harmful code, probe or bypass security, or interfere with the website or another visitor's use;
• use automated means in a way that imposes an unreasonable load, circumvents access controls or ignores instructions intended for automated systems;
• copy, extract or reuse a substantial part of the website or its database for a competing or commercial service without our written permission;
• impersonate another person, misrepresent an affiliation, send spam or use the website to promote unlawful activity; or

We may restrict or block access, remove submissions, or take other reasonable measures where we believe these Terms have been breached or action is needed to protect the website, visitors, merchants or third parties.

Intellectual property

The website's design, software, databases, compilation, text, graphics and other content are protected by intellectual-property laws and belong to us or our licensors, except for merchant materials, visitor submissions and other third-party content. Merchant names, logos and trademarks belong to their respective owners.

We grant you a limited, revocable, non-exclusive and non-transferable right to access and use the website for your personal, non-commercial use. These Terms do not transfer any intellectual-property rights to you. You may not remove rights notices or reproduce, distribute, modify or commercially exploit protected website content except as permitted by law or with the relevant owner's permission.

Website availability

We may update, change, suspend or discontinue any part of the website. We do not guarantee that the website or any particular offer, feature or link will always be available, uninterrupted, secure or error-free.

Disclaimers

To the maximum extent permitted by applicable law, the website and its content are provided "as is" and "as available" without warranties of any kind. We do not warrant that offer information is complete, current or error-free, that any discount will be accepted, or that a merchant will provide any product, service or benefit.

Nothing in these Terms excludes any warranty, right or remedy that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity, arising from or connected with the website, an offer, a destination website or your reliance on information available through the website.

To the maximum extent permitted by applicable law, our total liability arising from or connected with the website or these Terms will not exceed $100. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct or any liability that cannot lawfully be limited.

Privacy

Our Privacy Policy explains how we collect, use and disclose personal information when you use EverySaving.com, including in connection with submissions, analytics and outbound-link attribution.

Governing law and disputes

These Terms and your use of the website are governed by the laws of the Netherlands, without regard to conflict-of-law rules. This choice does not deprive you of any mandatory protection provided by the law that applies where you live.

If you have a concern or dispute, please contact us first so that we can try to resolve it informally. These Terms do not prevent either party from seeking a remedy that cannot lawfully be waived.

Changes to these Terms

We may update these Terms by publishing a new version on this page and changing the date above. If a change materially affects your rights, we will provide additional notice where required by law. Your continued use of the website after updated Terms take effect means that the updated Terms apply to that use.

Entire agreement, severability and waiver

These Terms are the entire agreement between you and us concerning your use of the website and supersede prior agreements or communications about that use. These Terms do not supersede our Privacy Policy.

If a provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply. A failure to enforce a provision is not a waiver of the right to enforce it later.

This policy explains how Oberst B.V. handles personal information collected through EverySaving.com. In this policy, "we", "us" and "our" refer to Oberst B.V. Our details are set out below.

"Personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with a particular person or household. It does not include information that applicable law treats as public, deidentified or aggregated information.

How we collect and use personal information

We do not provide consumer accounts on EverySaving.com. You do not need to log in, create a profile or make a purchase through us to use the website.

We may collect information about your use of the website ("usage data"). This may include your IP address, browser type and version, operating system, pages viewed, the time and date of your visit, impression and click events, merchant or coupon links you interact with, and similar diagnostic information. We use usage data to operate, secure, monitor and improve the website, prevent abuse, and understand which offers and pages are useful to visitors.

If you email us, we process the data you choose to send, such as your email address and message content, to handle your inquiry. When you submit coupon feedback, we process the coupon or offer concerned, whether it worked, any reason you select, the optional comment you choose to send, your browser's user-agent string and the submission time. We use this information to review feedback, improve offer quality, prevent spam and keep appropriate records.

When you submit a coupon, we may collect the coupon code, message, merchant or domain details you choose to submit, an optional email address and the submission time. We use this information to review submitted coupon information, prevent spam and keep appropriate records. If we accept a coupon you submit, the offer text, code or similar commercial information may be published on the website; your contact details are not published in that context.

When you use the merchant-feedback form, we process the free-text message you submit, the merchant the feedback concerns and the submission time to review feedback, prevent spam and keep appropriate records.

We do not intentionally collect payment-card data, government identifiers, health information or other sensitive personal information through the public website. Please do not include sensitive information or another person's personal information in free-text submissions unless we specifically ask you to do so.

We may also use personal information where reasonably necessary to comply with legal obligations, obtain professional advice, manage risk, protect the website and our rights, or establish, exercise or defend legal claims.

California information for the preceding 12 months

The California Consumer Privacy Act requires additional information about categories of personal information. During the preceding 12 months, we collected the following categories in the ordinary operation of the website:

• Identifiers, such as an email address you provide, IP address, online or session identifiers, and pseudonymous click references.
• Commercial information, such as merchants, coupons, offers and outbound links you view or interact with, and commercial information you include in a coupon submission or feedback.
• Internet or other electronic network activity, such as browser and operating-system information, pages viewed, timestamps, impressions, clicks, interactions with the website and diagnostic information.

Our forms are designed to collect only the categories described above. If you include other personal information in a free-text submission, we process it only as part of handling that submission. We do not ask you to include sensitive personal information in free-text fields.

For identifiers, commercial information, and internet or other electronic network activity, the retention period is determined using the criteria described in the "Retaining and deleting personal information" section below.

We collect this information directly from you when you send an email or submit information; automatically from your browser or device when you use the website; and from service providers that help us operate, secure, monitor and measure the website and attribute outbound clicks. We use it for the purposes described in the preceding section.

During the preceding 12 months, we disclosed identifiers, commercial information, internet or other electronic network activity, and information in user submissions to the service-provider categories described below for business purposes. The categories disclosed depend on the service performed. We may also disclose relevant information to professional advisers or public authorities for the legal purposes described below.

We do not sell or share personal information

We do not sell personal information for money or other valuable consideration, and we have not sold personal information. During the preceding 12 months, we have not sold personal information.

We also do not "share" personal information for cross-context behavioral advertising as that term is defined by California law, and we have not done so during the preceding 12 months. We do not process personal information for targeted advertising or for profiling that produces legal or similarly significant effects.

We disclose limited information to service providers that process it on our behalf under contracts and instructions. Those business-purpose disclosures are not sales or sharing for cross-context behavioral advertising. Because we do not sell or share personal information, these practices do not differ for consumers under 16.

Disclosing personal information

We disclose personal information to service providers only where reasonably necessary for the purposes described in this policy. These providers include cloud hosting providers, an email-hosting and communications provider, a content-delivery and website-security provider through which website traffic passes, a cookieless analytics provider, an outbound-link attribution provider, and an error and performance monitoring provider.

These providers process personal information on our behalf under contracts and instructions and are not permitted to use it for their own purposes. We describe them by category because the exact provider can change over time while the processing purpose remains the same.

When you choose to follow an outbound link, your browser communicates directly with the independent merchant, partner platform or other destination site. That destination receives the outbound URL, which may contain a SubID or pseudonymous click reference, and standard technical request data. Destination sites are independent recipients rather than our service providers, and their own privacy notices apply to their processing.

We may also disclose personal information to insurers, professional advisers, courts, regulators or public authorities where reasonably necessary for obtaining advice, managing risk, complying with the law, or establishing, exercising or defending legal claims. If ownership or control of all or part of our business changes, relevant information may be disclosed to advisers and a prospective buyer subject to appropriate safeguards, and transferred as part of the transaction where permitted by law.

Retaining and deleting personal information

We keep personal information only for as long as reasonably needed for the purposes described in this policy, unless a longer period is required for legal, security, accounting or dispute-resolution purposes. We consider the amount and sensitivity of the information, the risk of harm from unauthorized use or disclosure, the purposes for which we process it, whether those purposes can be achieved another way, and applicable legal requirements.

Usage and security data that can reasonably identify a visitor is kept for the shortest period reasonably needed to operate, secure, diagnose and measure the website. We may keep aggregated click, impression and performance statistics for longer where they no longer directly identify a visitor. When deciding how long to keep pseudonymous click references, we consider the periods reasonably needed for attribution, reconciliation, fraud prevention and reporting, as well as applicable legal and contractual requirements.

Data from email inquiries, coupon feedback, coupon submissions and merchant feedback is kept for as long as needed to respond, review the relevant submission, prevent abuse and keep appropriate business records. Records of privacy requests are kept as needed to demonstrate compliance and prevent fraud.

Security

We use reasonable physical, organizational and technical safeguards designed to protect personal information, including encrypted transfer of data between your browser and our servers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

International processing and GDPR information

Oberst B.V. is established in the Netherlands. We and our service providers may process personal information in the Netherlands, other countries in the European Economic Area, the United States and other countries where our service providers operate. Where EU data protection law requires safeguards for a transfer to a country without an adequacy decision, we use appropriate safeguards such as the European Commission's standard contractual clauses, as applicable, together with appropriate technical measures. You may contact us using the details below for more information about the relevant safeguards or to request a copy, subject to appropriate redactions.

Where the EU General Data Protection Regulation applies, Oberst B.V. is the controller. We rely on our legitimate interests to operate, secure, monitor and improve the website, handle submissions and inquiries, prevent abuse, and attribute outbound clicks, balanced against your rights and interests. We process information to comply with legal obligations where necessary, and rely on consent for any processing for which we specifically ask for it. We may also process information where necessary to establish, exercise or defend legal claims.

Where applicable, you may ask us for access to, correction or deletion of your personal information, restrict or object to processing, or request a portable copy. If processing is based on consent, you may withdraw that consent without affecting earlier processing. You may complain to the Dutch Data Protection Authority or another competent supervisory authority. These rights may be subject to legal exceptions.

U.S. state privacy rights

Residents of California, Virginia, Colorado, Connecticut, Texas and other states may have privacy rights, depending on whether the applicable state law covers our processing. Those rights may include the right to confirm whether we process your personal information; access, correct or delete it; obtain a portable copy; and obtain information about categories of recipients or specific third parties where required by law. You may also have the right to opt out of sale, targeted advertising or certain profiling, and to receive equal service without unlawful discrimination for exercising your rights.

As explained above, we do not sell personal information, share it for cross-context behavioral advertising, use it for targeted advertising, or use it for profiling that produces legal or similarly significant effects. We therefore do not currently offer a separate opt-out link for those practices.

To exercise an applicable privacy right, email us using the privacy address below and describe your request and state of residence. We may ask for information reasonably necessary to verify your identity and request. An authorized agent may submit a request where state law permits; we may ask for proof of the agent's authority and may need to verify your identity directly. We will respond within the period required by applicable law.

If we deny your request, you may appeal by replying to our decision and stating that you wish to appeal. We will explain our appeal decision and, where required, how to contact your state attorney general or another regulator.

Browser-based universal opt-out signals such as Global Privacy Control communicate a request to opt out of sale or targeted advertising. Because we do not engage in sale, targeted advertising or California sharing, receiving such a signal does not currently require any change to our processing. Other browser "Do Not Track" signals do not have a common industry standard, and we do not respond to them separately.

Our service providers process personal information only on our behalf. We do not permit them to collect personal information through EverySaving.com over time and across unrelated websites for their own purposes. When you choose to visit an independent destination site, that site's collection begins under its own privacy practices as described below.

Additional California rights

California residents may have the rights described above, including the right to know the categories and specific pieces of personal information we collected, the sources, purposes and recipient categories; to correct or delete personal information; and to receive a portable copy. California residents may also use an authorized agent and have the right not to receive discriminatory treatment for exercising their rights, subject to applicable exceptions.

For a verified California request, we will respond within 45 calendar days. If reasonably necessary, we may extend that period by up to 45 additional days after notifying you and explaining the reason. We provide responsive information without charge and in a readily usable, portable format where required, except that we may charge a reasonable fee or decline a request where applicable law permits us to do so.

We do not intentionally collect or use sensitive personal information to infer characteristics about consumers. We therefore do not provide a separate "Limit the Use of My Sensitive Personal Information" link. California's "Shine the Light" law permits certain requests about disclosures for third parties' own direct-marketing purposes; we do not disclose personal information to third parties for those purposes.

Children

EverySaving.com is a general-audience website and is not directed to children. We do not knowingly collect personal information from children, including children under 13, through the website. If you believe a child has provided personal information to us, please contact us so that we can investigate and delete it where appropriate. We do not sell or share anyone's personal information, including personal information of consumers under 16.

Analytics, outbound links and cookies

EverySaving.com does not currently show a cookie-consent banner. We use necessary and functional cookies and similar browser storage for core site functions, sessions, security, spam and abuse prevention, displaying coupon-code modals, and preventing duplicate interactions. You can control cookies through your browser settings.

Our website analytics is cookieless and first-party proxied. It helps us understand page views and clickout events without creating behavioral advertising profiles.

Some merchant links on EverySaving.com are monetized. When you click an offer, reveal a coupon code or follow a merchant link, your browser may be redirected to a merchant, partner platform or other destination site. The outbound link may include a SubID or similar technical tracking string so that clicks and any resulting commission can be attributed to EverySaving.com.

For our own clickout attribution, we may generate a pseudonymous click reference and add it to the outbound link. Your browser sends a limited clickout signal directly to an outbound-link attribution provider. The signal may include technical click information, such as the destination URL, the EverySaving.com page URL, a click reference, merchant or offer identifiers or labels, timing information, limited campaign or ad-click parameters in the URL and standard technical request data. The provider processes this information on our behalf and is not allowed to use it for its own purposes.

Our website contains links to websites and services that we do not operate or control. If you follow a link to another website, that website is responsible for its own content, privacy notices, cookies and similar technologies. We encourage you to review the privacy and cookie information of any website you visit.

Managing cookies

Most browsers allow you to refuse or delete cookies. The methods vary by browser and version. Current instructions are available from the browser providers:
